There is good news and bad news for Jussie Smollett and the Empire cast. The good news is that Empire will be returning to for a sixth season on FOX. The bad news for Jussie is that there are no plans for his return.

After being charged with filing a false police report and faking an attach by two men in a racial and bigoted attach, Jussie’s character was written out of the final two episodes of Season 5, much to the public’s delight. However, the charges against Jussie were dropped by the Cook County State’s Attorney and there was many question about Jussie’s return.  Now we know.

In a statement to E! News, FOX shared where they currently stand on the situation with Jussie’s character Jamal. “By mutual agreement, the studio has negotiated an extension to Jussie Smollett’s option for season six, but at this time there are no plans for the character of Jamal to return to Empire,” the statement said.

While many fans will agree that Jussie should not be on the show anymore, the cast of Empire took a different stance when they wrote a letter to FOX and Disney, supporting Jussie’s return to work since the charges were dropped.

“Together, as a united front, we stand with Jussie Smollett and ask that our co-star, brother and friend be brought back for our sixth season of Empire,” a letter sent to the Fox and Disney network and retrieved by E! News read. “Throughout Empire‘s five seasons working with Jussie and watching how he has conducted himself throughout this traumatic event, we have come to know not just the character Jussie portrays, but also truly come to know Jussie’s personal character. He is kind. He is compassionate. He is honest and above all he is filled with integrity.”

In the meantime, State’s Attorney Kim Foxx is being subpoenaed for her role in the dismissal of Jussie’s charges and Jussie’s lawyers, Mark Geragos and Tina Glandian are being sued for defamation by the Osundairo brothers, who were alleged to be involved in the attack. We’re pretty sure we haven’t heard the last of this situation.
