Kevin O’Leary’s troubles continue following the fatal boat crash he was involved in last summer.

This week, it was reported that the Shark Tank star and his wife Linda O’Leary are being sued by the family of one of the victims of the boat crash. Boat passenger Susan Brito passed away as a result of injuries sustained when O’Leary’s boat crashed into the vessel she was riding in on a lake in Canada.

According to the suit, the family of Brito is seeking punitive, exemplary and aggravated damages for wrongful death.

“For this grieving family, it is about obtaining civil justice so as to prevent these types of deaths and curtailing reckless and dangerous behavior from continuing on our lakes,” Patrick Brown, of McLeish Orlando LLP, said in a news release.

What makes this an even trickier case is the fact that Linda O’Leary was said to be driving the boat when the accident occurred. Police quickly administrated a DUI test on her, but Kevin O’Leary’s rep is said to have said that she passed the test. In September, she was charged with ‘careless operation of a vessel.’

Following the news Kevin released a statement through his agent Jay Sures, saying, “Now that the authorities have concluded their thorough investigation, I have no further comment other than to say that our thoughts and prayers are with the friends and families of those who lost loved ones in this awful tragedy. Our hearts go out to them.”

Brito was one of two people who died as a result of the crash. O’Leary has yet to make any public comment regarding the recent lawsuit.
